Hello Shields,As I mentioned I am retired and really enjoy living here in Ashland. The town is all that I hoped for, politics aside. In an effort to do something positive for the city I undertook the petition effort. I am not running for office and am not interested in spending money or time fighting with the restaurant association. My efforts on this matter are finished. If Ashland passes this measure it will be a good thing; perhaps the rest of the Rogue Valley will follow and then the entire state. If not a similar measure will eventually happen, most likely at the State level where it really belongs. Other states are doing it so sooner or later Oregon will catch up. What follows is the information I provided to the Chamber of Commerce. Attached to it were a list with the recent restaurant ratings from the Jackson County web-site and an article about the Orange County California Grand Jury chastising the Orange County government for not taking action on this sort of measure because it has been shown to be of great benefit.Good luck in all your efforts, John Jory *WHY RESTAURANTS SHOULD POST INSPECTION GRADES.* The Center for Science in the Public Interest, CSPI, urges every city and state to adopt a restaurant grading program, such as is done in Los Angeles County, where restaurants post, in the front window, a letter grade from inspectors indicating if they received an A, B, or C. *REASONS TO SUPPORT THIS MEASURE:*1. There is only one agency attempting to keep restaurants clean, Jackson County Environmental Health Dept. After inspection all that appears at the restaurant is a sticker that says whether the restaurant passed or failed inspection. The Medford Tribune this week said, “ It’s not particularly surprising that customers of Chinese Gourmet Express overlooked the recent failure of its semiannual health inspection. Both of the state’s sanitation stickers are the same shape and color, the only difference being “failed to comply” printed in red letters and “complied printed in blue letters.” The Medford Tribune lists some restaurant grades each week. But there are 117 places inspected in Ashland so it would take over a year to see all Ashland grades. Certainly our Tourists will never see health department grades. 2. Three Ashland restaurants have failed health inspections. Right now we have places that are 1 or 2 points away from failing their health department inspections. They are apparently satisfied to just meet the very minimum Health Department standards. A score below 70 is a failing grade. Here are two examples: GOLDEN DYNASTY 2006 2007 2008 62 62 79 76 71 CHUN'S PALACE 2006 2007 2008 71 71 54 79 70 *WHAT THIS MEASURE WILL COST RESTAURANTS: *The direct Cost will be taking the health department grade to the City Recorder 2 times a year and placing the grade card in a prominent place: maybe $20 a year. A possible added cost is extra cleaning to insure a good grade. Cost would vary but it should be noted that low cost fast food places like Burger King get good grades so meeting health department standards can not be too expensive. Also, over 60% of our restaurants would get A grades so they must just maintain their clean standards. 30% would get B’s so they should attempt to improve. About 10% would get C’s; these places need to do a lot more to be healthful places to eat. *WHAT ARE THE BENEFITS THIS MEASURE GIVES RESTAURANTS:*1. In locations where posting is done, A grade restaurants get 5% more business 2. B grade restaurants get about 1% more business. 3. Many of our visitors are from California and much of the state has similar laws now that San Francisco and Sacramento counties do it as well as all of Southern California.. 4. If Ashland posts, more customers will choose to eat here, even residents who don’t eat here now because of the restaurant tax. *WHAT WILL THE COST BE TO THE CITY:*This ordinance will primarily be self-enforcing and the cost should realistically be less than half the city’s estimate. Administration will require only 5 to 10 minutes a day to pass out about 250 grade cards a year when the restaurants bring in their inspection reports. That’s less than 1 grade card a day! Customers asking about missing grade cards and pressure from the over 60% of restaurants who get A’s will pressure all restaurants to post their grades. Health Department inspection reports are dated so a daily fine would make it costly for restaurants not to post. Any fines levied would bring revenue to the city. *PROVEN RESULTS FROM PLACES THAT REQUIRE GRADE POSTING: *1. Restaurants become cleaner. 2. Only C graded restaurants lose some business. A and B grade restaurants get more business. 3. Fewer customers get sick from restaurant food. With all the other problems with our food supply such as lettuce, spinach, chili peppers, tomatoes and ground beef recalls, this seems like an easy way to provide a little extra safety for consumers. *RESTAURANT ASSOCIATION POSITIONS AND STATEMENTS:*The industry argues consumers already have all the information they need. "If they're uncomfortable in a restaurant, walk out," said Mary Adolph of the National Restaurant Association. "You vote with your pocketbook." Do tourists, a revenue source that our city relies on, have this information? No. Out of 1800 people I contacted fewer than 10 said that they have used the Jackson County web-site. The information is public but effectively it is hidden from view. I spoke with a restaurant association representative who accused me of wanting to add another bureaucratic step to restaurants and it was unfair and not needed since the present system is working. How big a deal is it to have the restaurants walk to the city offices 2 times a year? I asked what the Restaurant Association representative was it doing about places that fail inspections and others that always get just passing grades. His answer, “Its not my job.” A further Restaurant Association comment was the grade is just a snapshot in time. A good restaurant can have a bad day and a bad restaurant a good day. My answer is that bad restaurants, especially ones like those listed above don’t have good days. It is true that a good restaurant can have a bad day but that has a solution. It can pay the County for a re-inspection and turn in the new report to the city. The cost for the re-inspection is $250 to $350. With the time allowed by the city for a restaurant to turn in its grade and the usually short time required for a re-inspection no bad letter grade need be displayed at all. *HISTORY:*I spoke with the Oregon State Health Department. Some 15 years ago, Oregon was a leader in restaurant safety and had a grade posting law. But, the Oregon restaurant association had a successful campaign to get the Oregon restaurant posting law rescinded. Later Oregon Health Dept passed a rule in which high scoring restaurants (A’s) received a certificate to be posted that indicated the excellence of their inspection report. The restaurant association went back into lobbying mode and got that rescinded also. They claimed it was discrimination against restaurants that were not clean enough to get the award. Attached is a list showing all the places within Ashland City Limits that are checked by the health department. As you can see, the majority would get A’s and many would get B’s. Unfortunately some always get C’s and presently have no reason to change their habits. *OTHER LOCATIONS THAT REQUIRE GRADE POSTING: *One web article said there are 80 places in the USA now requiring grade posting. My research found the following places require posting: Georgia, N. Carolina, S. Carolina, Mississippi, Chicago, Columbus Ohio, Most of the counties in Southern California as well as San Francisco and Sacramento counties. Lastly, a number of restaurant owners and restaurant workers signed this petition including as well as 95% of all the over 1,800 people I talked to. Published by shields on 10/03/08 01:00 AM
The proposal on the November ballot asks that an Ashland city grade be assigned to a state/county health scoring system. Ashland Restaurant scores are based on the County numerical scoring system that has been handed down for the State Health Department. This State/County numerical system was not created for and does not correspond accurately to a letter grading system. A restaurant that scores an 89 does not necessarily serve less safe food that a restaurant that scores a 91, but the former would be given a lower letter grade. Recently, one individual has proposed a ballot measure to revisit this letter grading issue. The current scoring system was not established to have letter grades applied to numerical scores; letters would not give consumers necessary information regarding the cleanliness of safety of a restaurant. Current numerical scores and relevant details for all Jackson County restaurants are readily available at www.co.jackson.or.us Click on “Popular Pages” and the click on “Restaurant Scores.” Local restaurant scores are also available in the Medford Mail Tribune typically new inspections are listed in the Sunday issue. Theses services are free. The current system is paid for without tax dollars; Ashland city officials have stated this grading system would cost $60,000 annually, that’s $600,000 in ten years!!! At a time when schools are closing, the local libraries struggle to stay open, the economy is in a down cycle, ask yourself. Do we need an additional layer of bureaucracy? Do you want your taxes to increase in Ashland? Some additional thoughts: Do educate yourself about the proposed Measure 15-88. Read your Voter’s Pamphlet, talk to a restaurant owner. Become an educated voter!!! The proponent to Measure 15-88 did not place an argument in the Voter’s Pamphlet. Does he have an argument? Recently the Ashland Chamber of Commerce Board of Directors voted unanimously to oppose this ballot initiative. In 2007 there where no incidents of food borne disease outbreaks in restaurants, the outbreaks where reported in retirement facilities, family gatherings and correctional facilities. This measure is being modeled after a program in California. California food handlers are not required to have a mandated food handler card like the servers in Oregon. With exception to three counties. Oregon was the first state to have mandated food handlers permits; we have a more educated workforce in Oregon. Proponents of Measure 15-88 have said that restaurants can ask for a new inspection and receive a new score if they are not satisfied with their original score- this is not true. The state of Oregon does not allow for voluntary re-testing in order to get a better score. DATE: October 3, 2008 TO: Martha FROM: Lee Tuneberg DEPT: Admin Services RE: Costs relating to Proposed Restaurant Ordinance Estimating the initial and ongoing costs of such a program is difficult. Much of it depends on what expectation there is for output or effective enforcement. The estimates I have seen appear to be wishful thinking by someone who wants the program to be implemented. Costs for it to be a successful program may be much higher because it will require setup, management and enforcement. Enforcement will not be effective if all the other steps leading to that point are done poorly. Current programs that are “complaint driven” or were established with minimal “upfront” costs present problems when someone (internal or external customer) actually wants something such as information, statistics, effective performance measures or simple enforcement. Without the appropriate investment upfront the output is ineffective, plagued by trial & error or cannot effectively be enforced. Thus, if the city wants an effective plan implemented, planning, processing and management must be done right. Examples of these are: Planning – The Code, policy and procedure must be established and followed with the desired outcome(s) in mind. Forms or placards showing the grade received must be unique enough to tell what restaurant the grade is for, the effective date or period it covers and must be tamper proof or not easily duplicated or transferred. Unique stickers of placards will be expensive for even a small quantity. Space, desks, computer, telephones, supplies, etc will be needed. I would budget $10,000 for these. Process – The steps to provide the service must be clear and efficient enough to guarantee the information being disseminated is accurate, timely and consistent. Complaints and claims could be filed against the City for lost business if something is done wrong causing damage to a restaurants reputation. Coordination and documentation of each step will take time. It is estimated that a 0.5 FTE clerk and a 0.5 FTE enforcement officer could be reality for this program - costing approximately $60,000. Management – Considerable administrative time will be spent in the beginning and eventually during the process if any enforcement is required. Complaints, claims and appeals should be expected. All will impact multiple departments and could end in front of Council. Quantifying these costs is nearly impossible at this time.

A truly local business, PureGeek doesn't even print an area code on their business cards. “If you need to dial a 1 when calling us, chances are we can't help you.” This doesn't mean that PureGeek limits its business to Ashland. “AFN is Ashland only, but computer problems are universal, and therefore we will go where we're needed. If someone in Grants Pass or Klamath Falls needs support, we'll be there” Rush said. This is to combat the rising tide of ISP's that farm out their support to other states and even other countries. “My feeling is why would someone in Chicago care what happens in Ashland? They wouldn't, and that comes through when you talk to them on the phone” Along with Rush is support tech Wayland Hense. Between the two of them they have over 15 years of experience. Marty has worked for other AFN ISP’s and for AFN almost since the beginning and even installed the first AFN home connection. “I'm lucky in that my hobby and my job are the same thing” Rush said. “I spend most of my day working on other people's computers, then go home and work on mine”. Wayland is recently off a stint as training guru at Webring, a local internet company. When asked about the difference between phone support and actual on site support Wayland said “you wouldn't call your mechanic and expect him to tell you how to fix your car over the phone, would you? Then why do it with something more complicated?” as he puts it, “computers can only do what they're told. And sometimes they get confused and need someone to help unconfuse them.” The company is the brain child of Marty Rush, Ashland resident. “I've worked for other ISP's and AFN itself, and I feel I'm ready to give the people of Ashland what they need. I've seen what works and what doesn't, and I'm ready to make things work right.” after years of seeing ISP's being run by salesmen, who are only thinking of the bottom line, Rush thinks people are ready for the geeks to take over. “I got tired of being told it's not cost effective to help people, that if our computer says they have internet, then our job is done”. The internet has become a basic part of our lives. We rely on it for information on almost everything, from recipes to who won the 1908 World Series. We come to count on it being there when we want, and when it isn't, we get annoyed and frustrated. Mystic Garden Party happenings are more then just an ecstatic festival & retreat gathering experience! We combine inspired and conscious music along with engaging healing arts workshops and high vibrational organic & raw food options to serve our mission: "To advocate healthy culture & community through music, arts & education." We will offer Yoga 3 times a day along with a plethora of healing modalities including rebirthing, sound healing, Ecstatic Dance and Watsu (since this gathering is at a hot springs spa). This year we're also adding a Visionary ArtsVillage featuring transformational art focused on planetary expansion of consciousness, along with an EcoVillage featuring sustainable solutions and a Meditation Dome where we'll have guided meditations, ceremonies and other healing arts journeys.
